By accessing or placing an order on this website, you agree to be bound by these Terms and Conditions. These Terms should be read together with our Privacy Policy and Returns & Refunds Policy, which form part of this agreement.

2. Contract Formation

All orders placed on this website constitute an offer to purchase goods. A contract is formed only when:

  • You receive an order confirmation email, and

  • The order is accepted and dispatched by Yugen Factory.

We reserve the right to refuse or cancel any order prior to dispatch.

3. Motorsport, Competition Use & Road Legality

  • Performance parts, bodywork, aerodynamic components, and polycarbonate window sets sold by Yugen Factory are designed primarily for motorsport, track, drifting, and off-road applications.

  • It is the customer's sole responsibility to verify whether installed components comply with regional vehicle safety regulations, road-use laws, and MOT/TÜV/inspection requirements in their jurisdiction.

  • Motorsport and track driving are inherently risky. Yugen Factory assumes no liability for vehicle damage, component wear, or injuries resulting from track use or aggressive performance environments.

4. Fitment & Professional Installation Disclaimer

  • All products must be prepared, trial-fitted, and installed by qualified automotive professionals.

  • Parts must be inspected and trial-fitted to the vehicle prior to final installation, painting, trimming, or drilling.

  • Yugen Factory accepts no liability for damage caused to the part, vehicle, or third-party labor costs incurred during the trial or final fitting process.

  • Non-Returnable Alterations: Items that have been painted, drilled, modified, scratched, or damaged during test-fitting or installation cannot be returned under any circumstances.

5. Pricing and Payment

  • All prices are shown in EUR (€) and include applicable taxes unless stated otherwise.

  • Payment must be made at the time of order via the available checkout payment methods.

  • Orders will not be processed or scheduled for dispatch until full payment is confirmed.

6. Delivery

  • Delivery times provided before or after purchase are estimates.

  • Orders are typically dispatched within 6–8 working days. Delivery within the EU is generally completed within 4–12 working days post-dispatch unless otherwise stated.

  • If delivery exceeds 30 days without prior agreement or notice, you maintain the right to cancel your order and receive a full refund.

  • Risk in the goods passes to you upon physical delivery to the designated shipping address.

7. Right of Withdrawal & Made-to-Order Exceptions (EU Consumers)

In accordance with EU consumer law (EU Consumer Rights Directive 2011/83/EU):

  • Standard Stock Items: You have the right to cancel your purchase within 14 days without giving any reason. The withdrawal period expires 14 days after you (or a designated third party) take physical possession of the goods.

  • Custom & Made-to-Order Items (Non-Refundable): Under Article 16(c) of the EU Consumer Rights Directive, the right of withdrawal does not apply to goods that are made to the consumer’s specifications or are clearly personalized/made-to-order. Products that are manufactured individually upon order (including custom-moulded polycarbonate window sets or bespoke fabrication parts) are strictly non-refundable and non-returnable, unless they arrive damaged or defective.

  • To exercise your right for eligible stock items, you must notify us in writing via info@yugenfactory.com. You must return the goods within 14 days of notifying us.

  • Upon receipt and inspection of returned stock items, refunds will be issued within 14 days via the original payment method.

  • Shipping Refund Terms: Standard outgoing delivery costs will be refunded upon full order cancellation of stock items. However, return shipping costs are the sole responsibility of the customer.

8. Returns and Refunds

All returns are handled in accordance with our Returns & Refunds Policy.

  • Eligible Return Condition: Items must be returned unused, uninstalled, unpainted, in their original condition, and with original packaging intact.

  • RMA Requirement: Customers must receive a Return Merchandise Authorization (RMA) from info@yugenfactory.com prior to returning any shipment. Unsanctioned returns will be rejected.

  • We reserve the right to refuse or partially refund returns that do not meet these conditions.

9. Faulty or Incorrect Goods

Under applicable statutory consumer law, if goods arrive faulty, damaged in transit, or not as described:

  • You are entitled to a repair, replacement, or full refund.

  • Transit damage or defective items must be reported to info@yugenfactory.com within 48 hours of receipt, accompanied by clear photo/video evidence prior to any installation attempt.

10. Customs, Duties & International Orders (Non-EU)

  • Orders shipped outside the European Union may be subject to import duties, local taxes, and customs handling fees imposed by the destination country.

  • All import charges are the sole responsibility of the customer.

  • Refused Deliveries: If an international package is refused by the recipient due to unpaid customs duties/taxes, any return shipping charges, freight costs, or processing fees incurred by Yugen Factory will be deducted from the customer's product refund.

11. Use of Website

You agree:

  • Not to misuse this website or upload malicious code.

  • Not to provide false, inaccurate, or fraudulent information.

  • That all payment details provided are valid and authorized by you.

We reserve the right to suspend or terminate site access for misuse.

12. Data Protection and Cookies

  • We process personal data strictly in accordance with the European Union General Data Protection Regulation (GDPR).

  • We utilize essential cookies, analytical tools (such as Google Analytics), and functional technologies to operate our store. Non-essential cookies are only deployed with your consent.

13. Limitation of Liability

To the extent permitted by law:

  • Yugen Factory is not liable for indirect, incidental, or consequential losses, labor costs, vehicle downtime, or workshop charges.

  • Our maximum total liability for any order is strictly limited to the purchase price of the goods in question.

  • Nothing in these Terms excludes liability for death or personal injury caused by proven gross negligence or fraud.

14. Force Majeure

We are not liable for failure or delay in performing obligations due to events beyond our reasonable control, including raw material supply chain disruptions, transport strikes, severe weather, natural disasters, or government restrictions.

15. Changes to These Terms

We reserve the right to update these Terms at any time. The version in force at the time of purchase will apply to your transaction.

16. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of Spain. Any legal disputes shall be subject to the jurisdiction of the competent courts of Alicante, Spain.
